Your Contribution

• Advice: Provides general legal (patent) in-house support and advice regarding legal (patent) issues to organizational units and project managers as well inventors of the SCHOTT Group in China/Asia; Monitors and assesses third-party patent positions with regard to relevance for SCHOTT products or developments; Checks SCHOTT developments and products for interference with third-party patent positions and provides technical and legal information on collision avoidance (Freedom-to-Operate analysis).

• Prosecution: Supports actively research and technology projects inclusive identification of new inventions. Assesses inventions with regard to protectability. Drafts patent applications, if necessary, in cooperation with external attorneys, and determines the scope of protection of the patent claims. Conducts patent prosecution proceedings for the SCHOTT Group with the respective patent authorities in China/Asia including issuing instructions to the respective correspondent attorneys where applicable. Enforces company’s patent positions and supervises patent court cases and litigations in China/Asia.

• Opposition: Checks feasibility of opposition and appeal proceedings as well as cancellation actions against third-party property rights where necessary, conducts such proceedings, if necessary, in cooperation with external attorneys. Develops arguments to defend against third-party claims for alleged patent infringement or recommends alternative solutions to the organizational units or subsidiaries.

• Contracts/Agreements: If necessary, drafts IP and Know-How contracts, R&D and cooperation agreements and Non-Disclosure Agreements (NDAs) if necessary, in cooperation with the supervisor, examines third-party drafts, implements necessary changes in the interest of the SCHOTT Group where applicable. If necessary, negotiates contracts with third parties in coordination with the supervisor and makes decisions in cooperation with the relevant organizational unit or subsidiaries of the SCHOTT Group.

Your Profile

• 3 years in company’s patent department or patent law firm
• Completed university degree in natural sciences (Chemistry, Physics, Physical Chemistry) or Mechanical Engineering; graduated as patent attorney / patent agent or comparable education
• Broad knowledge in international IP law, especially patent law, general contract law, licensing and antitrust law; IP Management; Excellent communication and negotiation skills in English, further languages beneficial; outstanding organizational skills
